Scott acts for statutory bodies, insurers and companies in a broad range of personal injury matters across multiple statutory and insurance schemes.

Biography

Scott's principal area of practice is acting for WorkSafe Victoria, its agents and its insured employers in pre-litigated and litigated serious injury applications and common law damages claims, dependency claims following work-related deaths, and statutory benefits disputes.

Recognised for his strong technical skills and in-depth knowledge of the WorkCover scheme, Scott is mostly engaged in WorkSafe’s most complex and sensitive claims, including damages claims involving disputed liability, multiple parties, mental injury, dust diseases, cross-jurisdictional issues, imminent risk of death, and novel or significant legal questions.

In addition to his disputes practice, Scott is regularly consulted by WorkSafe for his advice on complex and sensitive claims outside the litigation context as well as policy issues.

A defining feature of Scott’s practice is the breadth of his experience across a range of compensation and insurance schemes. In addition to acting for WorkSafe Victoria, he advises and represents self-insurers under the WorkCover scheme, the Transport Accident Commission, the Country Fire Authority, as well as government agencies and insurers in the Commonwealth compensation and public liability areas.

Acting for clients in all levels of the Victorian and Australian Court system, including in proceedings in VCAT and the Magistrates’, County and Supreme Courts, judicial review proceedings in the Supreme Court, and appeals in the Court of Appeal and the High Court of Australia.

Advising and acting for WorkSafe Victoria, its agents and self-insurers in complex pre-litigated and litigated personal injury claims, statutory benefits proceedings, and dependency claims, with a focus on complex claims including mental injury and dust disease.

Statutory compensation across schemes

Advising and representing government bodies, statutory authorities and insurers across a range of compensation and insurance schemes, including TAC, CFA volunteer compensation, Commonwealth compensation and public liability.
